HIGH COURT ORDERS IEBC TO INCLUDE EKURU AUKOT IN THE BALLOT PAPER


The High court has demanded that all the presidential candidates who were in the August 8 polls be included in the ballot paper in the October 26 fresh presidential elections.

The court said that it would be discriminatory not to allow Ekuru Aukot to be on the ballot as it was a violation of his human right to political participation. 

The High court has demed the word ‘fresh’ under article 140(3) of the constitution should not be embossed with article 138(5)of the constitution as they serve different situations and not a similar scenario. 

Justice John Mativo said the fact that the Supreme Court ordered for fresh elections and nullified the August polls meant that the elections were void and that it was the right of all presidential candidates to appear on the ballot.
